GENERAL TERMS AND CONDITIONS OF THE PROMOTIONAL CAMPAIGN „ SOFIA RESTAURANT WEEK“



SECTION 1. ORGANIZER OF THE PROMOTIONAL CAMPAIGN

1.1. The Promotional Campaign “SOFIA RESTAURANT WEEK“ (“Campaign”) is organized by Restaurant Week Ltd. (“Organizer”), UIC 204137322, with its seat and management address in Sofia 1000, Sredets region, No 37 William Gladstone str., represented by its manager Kristin Milner Morov,



The Campaign is organized with the assistance of Mastercard Europe SA, Belgian Joint-Stock Company.

Prizes under the Campaign shall be provided with the assistance of the advertising agency “MACCAN Erikson Sofia” OOD, registered in the Commercial Register at the Registry Agency under UIC 121003246, having its seat and registered address in Novi Iskar, No 15 Targovska str. (“The Agency”) and „Mastercard”.
1.2. Mastercard is not an Organizer of the Promotional Game and shall not be held liable by governmental authorities, natural persons or companies, participants in the Promotional Game in relation to the terms and conditions of the Promotional Game, the mechanism for participation. Participants should contact the Organizer in relation to all issues concerning the Promotional Game. All requests, notifications and other communications should be forwarded to the Organizer to the indicated correspondence addresses in these General Terms & Conditions.
1.3. The Promotional Campaign shall be conducted in compliance with these General Terms & Conditions.

SECTION 2. GENERAL REGULATIONS OF THE PROMOTIONAL CAMPAIGN

2.1. Participants in the promotional campaign are obliged to comply with these General Terms and Conditions of the Promotional Campaign.
2.2. These General Terms and Conditions are prepared in compliance with the requirements of the Bulgarian legislation and are published on https://restaurantweek.bg for the period of the Promotional Campaign.
2.3. The Organizer shall retain the rights to supplement or amend these General Terms and Conditions; any amendments shall come into force upon publishing on the website https://restaurantweek.bg.

2.4. By the performance of a participation fee on the website https://restaurantweek.bg under these General Terms and Conditions, each participant accepts these General Terms and Conditions and the Promotional Campaign’s terms and conditions. If a participant disagrees with these General Terms and Conditions or amendments to these General Terms and Conditions the participant should suspend its further participation in the Promotional Campaign. Suspension of the participation shall be realized upon explicit written request forwarded to the Organizer to the following email: support@restaurantweek.bg

SECTION 3. PERIOD AND TERRITORY OF THE PROMOTIONAL CAMPAIGN

3.1. The Promotional Campaign shall take place in the period from 09.09.2019 to 15.09.2019 incl. The Organizer at its own discretion shall amend the Promotional period by its extension or early termination. Such amendments to the Promotional period shall be indicated in these General Terms and Conditions.

3.2. Territory  where the Campaign is held:
- The Campaign shall take place on the territory of the Republic of Bulgaria and the website https://restaurantweek.bg. The participating venues are specified on the webpage above.

SECTION 4. ELIGIBILITY FOR PARTICIPATION
4.1. Each natural person that participates in the Promotional Campaign in compliance with the Promotional Campaign’s requirements and accepts these General Terms and Conditions shall be considered eligible for participation in the Promotional Campaign.

4.2. Eligible for participation in the Promotional Campaign shall be each natural person - holder of a valid Mastercard® card – all types of credit and debit cards, issued by a bank or a financial institution located on the territory of the Republic of Bulgaria, prior the starting date of the Campaign.

4.3. Eligible for participation in the Promotional Campaign shall be participants above the age of 18.
4.4. Participation in the Promotional Campaign shall be admissible to all participants who have made a rezervation and have paid a participation fee of BGN 30 for the еvent “Sofia Restaurant Week” on the https://restaurantweek.bg page online with a valid Mastercard issued before the start date of the campaign, during the Promotional campaign who have provided their names, phone number, email, and have agreed to these Terms and Conditions and the information requirements. The event will take place from 21.09.2019 to 29.09.2019 in the cities of Sofia, Plovdiv and Varna.

4.5. Participation in the Promotional Campaign is preconditioned by the performance of a payment for BGN 30 on https://restaurantweek.bg for reservation, with a valid Mastercard card, issued on a date prior to the start of the campaign.


4.6. Employees of the Organizer and the Agency, their subsidiaries, affiliates and partners, participating in the organizing and conduction of the Promotional Campaign, as well as members of their families (children and spouses) shall not be eligible for participation in the Promotional Campaign.
4.7. Organizer of the Promotional Campaign is entitled at its own discretion without any notification or argument due to exclude a participant from further participation in the Promotional Campaign if without any limitation the participant is not eligible to participate in the Program and/or breach any of the provisions of these General Terms and Conditions.

SECTION 5. PROTECTION OF PERSONAL DATA

5.1. Participation in the Campaign is voluntary. Upon participation each participant provides the following personal data – three names, contact phone and email. The Organizer shall be held liable for the collection, processing and usage of personal data of the participants provided in the Promotional Campaign.

5.2. Provision of personal data is voluntary. If a participant refuses to provide personal data or withdraws its consent its further participation shall be suspended.

5.3. For participation each participant has to agree provided personal data to be collected and processed for the purposes of the Campaign.

5.4. The Organizer shall not be held liable and shall not pay any compensation to persons whose personal data is provided or used for participation in the Campaign by another person no matter if with or without the person’s consent.
5.5. The Organizer declares that collected personal data shall not be provided to third parties Each participant may withdraw its consent regarding processing of the personal data upon which its further participation shall be suspended.
5.6. Provided personal data in the Campaign shall be deleted no later than 3 months as of provision of the prize.
5.7. Each participant may access his personal data processed by the Organizer and request deletion, transfer or correction of the personal data by means of a written request forwarded to the Organizer to its address of management, signed personally or by person authorized with notary certified power of attorney, or to the following e-mail: desislava_arnaudova@mmcann.bg

5.8. Every participant has the right to contact the Commission for Protection of Personal Data if he considers his rights for protection of personal data breached (Address: Sofia 1592, No 2 Prof. Tsvetan Lazarov blvd., kzld@cpdp.bg, www.cpdp.bg).


SECTION 6. PARTICIPATION IN THE PROMOTIONAL CAMPAIGN

6.1. During the Campaign, users can register with a payment on https://restaurantweek.bg made using a valid Mastercard for the payment of the participation fee (ticket) of BGN 30. 
6.2. Each participant may register once for a certain venue.
6.3. Each participant that has paid a participation fee and fulfilled the conditions under item 6.1, participates in the lottery to win one ot the prizes under item 7.1, which will be drawn on 16.09.2019.

SECTION 7. DESCRIPTION OF PRIZES

7.1. The prizes are: 100 bottles ot wine and each winner is receiving one bottle, which will be ot the table in the restaurant.
- All winners will have the opportunity to agree to be photographed during the event in order for the Organizer and/or Mastercard to cover the event.
7.2. The Prizes provided may not be subject to transfer or exchange against money or other benefits.

SECTION 8. STATUS OF THE PRIZES UNDER THE LAW ON NATURAL PERSONS’ INCOME TAXES 

8.1. Pursuant to law of taxes on the income of natural persons, prizes in excess of BGN 100 (one hubdred) BGN are subject to rate with final tax. This tax is paid by the Organizer.
8.2. The winner is under no obligation to file an annual tax return on this basis.


SECTION 9. TERMINATION OF THE PROMOTIONAL CAMPAIGN

9.1. The Organizer may unconditionally terminate the Promotional Campaign at its own discretion, as no compensation shall be due to the participants.


SECTION 10. LIABILITY

10.1. The Organizer, the Agency and Mastercard shall not be held liable and shall not be obliged to participate in any legal proceedings related to impossibility of usage of a prize due to reasons beyond Organizer’s control.
10.2. The Organizer, the Agency and Mastercard shall not be obliged to communicate any contestations forwarded by participants, not determined as winners, after provision of the prizes.
10.3. The Organizer, the Agency and Mastercard shall not be held liable for any technical problems related to the Campaign due to reasons out of Organizer’s control.
10.4. The Organizer, the Agency and Mastercard shall not be held liable in any way and will not pay any compensation to participants who have provided wrong information or have misused the eligibility criteria when participating the Promotional Campaign.



SECTION 11. DISPUTES

11.1. All disputes between the Organizer and the participants in the Promotional Campaign shall be arranged by mutual consent. Otherwise the dispute shall be subject to resolution by the competent court in Sofia, Bulgaria.

11.2. Contestations by participants related to conduction of the Promotional Campaign may be sent in written or via email to the addresses indicated in these General Terms and Conditions. Each Participant should send its contestation not later than the end date of the campaign. Contestations sent beyond this term shall not be subject to resolution.
11.3. These General Terms and Conditions shall be binding for all participants and winners in the Promotional Campaign All decisions of the Organizer regarding the Promotional Campaign are final and shall not be subject to review by the participants.
